TERMS OF SERVICE

1. Introduction

Welcome to Maident Cleaning Services (“Maident”, “we”, “our”, “us”). These Terms of Service (“Terms”) govern the access to and use of all cleaning, fumigation, pest control, laundry, upholstery, post-construction, commercial, residential, and related services provided by Maident Cleaning Services. By booking, requesting, scheduling, paying for, or allowing us to perform any service, you agree to be bound by these Terms in full.

These Terms are designed to protect both our clients and Maident Cleaning Services by clearly explaining rights, obligations, limitations, and expectations. Please read them carefully before engaging our services. If you do not agree with any part of these Terms, you should not proceed with booking or using our services.

Maident Cleaning Services operates primarily within Kenya and serves residential, commercial, industrial, and institutional clients. These Terms apply to all customers unless otherwise agreed in writing.


2. Definitions

For clarity and consistency throughout this document, the following definitions apply:

  • “Client” / “Customer” refers to any individual, business, organization, or entity that requests or receives services from Maident Cleaning Services.

  • “Services” refers to all cleaning-related services offered by Maident Cleaning Services, including but not limited to house cleaning, office cleaning, sofa and upholstery cleaning, carpet cleaning, mattress cleaning, post-construction cleaning, roof cleaning, cabro and stone cleaning, fumigation and pest control, laundry services, polishing, and specialized cleaning.

  • “Agreement” refers to the binding contract formed when the Client accepts these Terms and confirms a service booking.

  • “Site” / “Premises” refers to the property or location where services are to be performed.

  • “Booking” refers to any confirmed request for services via phone call, website, social media, email, or in-person communication.

  • “Quotation” refers to an estimated price provided based on information supplied by the Client.


3. Scope of Services

Maident Cleaning Services provides professional cleaning and hygiene solutions tailored to the Client’s needs. Services may include, but are not limited to:

  • Residential house and apartment cleaning

  • Office and commercial cleaning

  • Sofa set, upholstery, curtain, and mattress cleaning

  • Carpet cleaning and restoration

  • Post-construction and renovation cleaning

  • Roof, cabro, tile, marble, stone, and wooden floor cleaning and polishing

  • Fumigation and pest control services

  • Laundry, ironing, and pressing services

  • External and compound cleaning

  • Specialized deep cleaning services

The exact scope of services will be agreed upon before commencement and may vary depending on site conditions, materials, access, and client instructions. Any services not explicitly agreed upon are excluded unless confirmed in writing.


4. Booking and Service Confirmation

4.1 Booking Process
Clients may request services through phone calls, WhatsApp, website forms, social media platforms, or email. A booking is only confirmed once Maident Cleaning Services acknowledges and schedules the service.

4.2 Accuracy of Information
The Client is responsible for providing accurate and complete information regarding the premises, size, condition, type of surfaces, level of dirt, and any special requirements. Incorrect or incomplete information may result in price adjustments, service delays, or refusal to proceed.

4.3 Right to Refuse Service
Maident Cleaning Services reserves the right to refuse or discontinue services if the premises are unsafe, inaccessible, or if conditions differ significantly from those described during booking.


5. Quotations and Pricing

5.1 Estimates Only
All quotations provided are estimates based on the information available at the time. Final pricing may change after physical inspection or if additional work is required.

5.2 Price Adjustments
Prices may be adjusted due to:

  • Additional areas or services requested

  • Heavily soiled or damaged surfaces

  • Inaccurate information provided by the Client

  • Restricted access or delays beyond our control

5.3 Taxes and Fees
Unless stated otherwise, all prices are exclusive of applicable taxes, levies, or statutory charges.


6. Payment Terms

6.1 Payment Methods
Payments may be made via mobile money, bank transfer, or cash, as agreed.

6.2 Payment Timeline
Unless otherwise agreed, full payment is due immediately upon completion of services. For large or commercial projects, deposits or staged payments may be required.

6.3 Late Payments
Late payments may attract penalties, interest, or suspension of future services.

6.4 Non-Payment
Failure to make payment may result in legal recovery actions, and the Client shall be responsible for all associated costs.


7. Client Responsibilities

The Client agrees to:

  • Provide safe and reasonable access to the premises

  • Secure valuables, fragile items, and personal belongings

  • Inform Maident Cleaning Services of any hazards, defects, or sensitive materials

  • Ensure availability of water, electricity, and access as required

  • Keep children, pets, and unauthorized persons away from work areas

Maident Cleaning Services shall not be held responsible for delays or damages arising from failure to meet these responsibilities.


8. Health, Safety, and Environmental Practices

Maident Cleaning Services is committed to maintaining high standards of health, safety, and environmental responsibility. We use industry-approved equipment, trained personnel, and suitable cleaning agents.

Clients must disclose any health risks, allergies, or environmental sensitivities prior to service. While we take reasonable precautions, Maident Cleaning Services does not guarantee allergen-free or bacteria-free environments.


9. Fumigation and Pest Control Specific Terms

9.1 Clients must vacate premises during fumigation as instructed.
9.2 Food items, utensils, pets, and sensitive equipment must be secured.
9.3 Re-entry timelines provided must be strictly followed.
9.4 Maident Cleaning Services shall not be liable for adverse effects arising from non-compliance.


10. Damage, Breakage, and Liability

Maident Cleaning Services exercises reasonable care while performing services. However, due to the nature of cleaning, some wear, discoloration, or pre-existing damage may become visible after cleaning.

We are not responsible for:

  • Pre-existing damages

  • Normal wear and tear

  • Weak, deteriorated, or improperly installed items

  • Damage caused by defective materials or structures

Any claims must be reported within 24 hours of service completion.


11. Satisfaction Guarantee

Client satisfaction is important to us. If you are dissatisfied, notify us within 24 hours. We may, at our discretion, re-clean the affected area. Refunds are not guaranteed and are issued solely at our discretion.


12. Cancellations and Rescheduling

12.1 Client Cancellations
Cancellations made less than 24 hours before scheduled service may attract a cancellation fee.

12.2 Rescheduling
Rescheduling is subject to availability and must be communicated in advance.

12.3 Company Cancellations
Maident Cleaning Services reserves the right to reschedule or cancel due to unforeseen circumstances.


13. Delays and Force Majeure

We shall not be liable for delays caused by events beyond our control, including but not limited to weather conditions, power outages, strikes, traffic, government actions, or natural disasters.


14. Confidentiality and Privacy

All client information is treated as confidential and used solely for service delivery and business purposes. We do not sell or share personal data except as required by law.


15. Intellectual Property

All content, branding, logos, text, and materials belonging to Maident Cleaning Services remain our intellectual property and may not be used without prior written consent.


16. Subcontracting

Maident Cleaning Services may engage subcontractors when necessary. All subcontractors operate under these Terms and our supervision.


17. Insurance

Maident Cleaning Services maintains appropriate insurance coverage where applicable. However, insurance does not cover all risks, and clients are encouraged to maintain their own insurance.


18. Limitation of Liability

To the maximum extent permitted by law, Maident Cleaning Services shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the amount paid for the specific service.


19. Indemnification

The Client agrees to indemnify and hold harmless Maident Cleaning Services against any claims, losses, or damages arising from misuse of services or breach of these Terms.


20. Complaints and Dispute Resolution

Complaints should be raised promptly. Parties agree to attempt amicable resolution before pursuing legal action.


21. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.


22. Amendments

Maident Cleaning Services reserves the right to update or modify these Terms at any time. Continued use of services constitutes acceptance of revised Terms.


23. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force.


24. Entire Agreement

These Terms constitute the entire agreement between the Client and Maident Cleaning Services and supersede all prior agreements or representations.


25. Acceptance

By booking or using our services, you confirm that you have read, understood, and agreed to these Terms of Service.
